Shareholder, partner and family disputes
Introduction
Resolving disputes over control, management, profits and exit between shareholders, partners and members of business families.
Disputes between owners are rarely only legal. They involve control of the company, the conduct of managers, access to information and dividends and, in family businesses, relationships that will outlast the case. Handled badly, they can stop the company itself from working.
We act for shareholders, partners, boards and families in claims under the Companies Law and the company's own documents: the articles of association, shareholder agreements and family charters. Our work covers claims against directors and managers, challenges to general assembly resolutions, deadlock, exit and the valuation of shares.
Where the relationship matters, we look first for a negotiated or mediated outcome, often a structured exit or a revised governance framework. Where it does not, we litigate before the commercial courts, or arbitrate where the parties have agreed to it.
