Fraud, breach of trust and embezzlement

Introduction

Acting for companies and individuals when money or assets are taken by deception or misused by those trusted with them.

The Anti-Financial Fraud and Breach of Trust Law, in force since 2021, sets heavy penalties for obtaining money by deception and for misusing money or property entrusted to someone, while embezzlement of public funds falls within the anti-corruption regime. In companies the cases often involve employees, managers or partners: false invoices, diverted payments, misuse of company accounts or assets taken on departure.

Where the victim is the company, speed matters. We help secure evidence, file complaints with the Public Prosecution, seek precautionary measures over the assets involved and pursue the company's private right to compensation alongside the criminal case.

We also defend executives and employees accused of fraud or breach of trust, testing the evidence of intent and loss, and separating genuine business decisions from criminal conduct.
