Government tenders and contracts

Introduction

Advising bidders and contractors through government tenders, contract award and performance under the Government Tenders and Procurement Law.

Government contracting follows its own law. Tenders run through the Etimad platform, contracts follow standard forms, and the rules on local content, guarantees, penalties and change orders differ from those in private contracts.

A new Government Tenders and Procurement Law, issued by Royal Decree No. M/76 and published in September 2026, enters into force at the start of January 2027. It raises the direct purchase ceiling, allows contract value to grow by up to 20% instead of 10%, permits contracts to move between government entities, and requires entities to settle contractors' dues before taking on new commitments. Contractors need to know which law governs each contract.

We help bidders review tender documents and raise questions in time, prepare compliant bids, and object to award decisions where the rules allow. During performance we advise on change orders, delays, penalties and compensation claims, and represent contractors before the administrative courts of the Board of Grievances.
