Technology partnerships and data transfers

Introduction

Structuring partnerships between technology companies, and moving data between them and across borders lawfully.

Many technology projects in the Kingdom are partnerships: a global provider with a local partner, a bank with a fintech, a hospital with an AI developer. Each needs clear terms on contributions, ownership of jointly developed technology, use of each party's data, exclusivity and exit.

Data transfers outside the Kingdom are regulated. Under the Personal Data Protection Law and SDAIA's transfer regulation, personal data may leave the Kingdom only on the permitted grounds and with appropriate safeguards, such as standard contractual clauses, and some sectors keep stricter rules on data localisation.

We structure partnership and joint development agreements, map data flows between partners and across borders, and put in place the transfer safeguards and assessments the law requires.
